1. Seniority

(A) Direct Recruits

  • Seniority is fixed as per order of merit in the select list.

  • Date of confirmation is irrelevant (rule effective from 04-11-1992).

  • If candidates are drawn from reserve panels, seniority follows the original consolidated merit.

  • Where multiple panels are issued on the same date, seniority is decided by:

    1. Date of recommendation

    2. Date of interview board

    3. Date of requisition
      (For exams: date of result declaration)

(B) Promotees

  • Seniority in promoted grade = same order as in feeder grade.

  • A senior found unfit earlier and promoted later cannot regain seniority over juniors.

  • Seniority depends on selection panel, not confirmation date.

(C) Direct Recruits vs Promotees

  • Governed by:

    • Vacancy Register

    • Rotation of quotas as per Recruitment Rules

  • Supreme Court (K. Meghachandra Singh, 19-11-2019):

    • Seniority is based on year of actual appointment, not year of vacancy.

  • If one category is short:

    • Rotation applies only to available candidates

    • Remaining vacancies are carried forward

  • If none available from one source → bunching of the other.

(D) Absorption / Deputation

  • Absorbees’ seniority is based on order of selection.

  • Absorption after deputation:

    • Seniority counts from earlier of:

      • Date of holding equivalent post on deputation, or

      • Date of regular appointment in parent cadre

(E) Special Cases

  • Compassionate appointment:

    • Placed at bottom of seniority of that year

  • Re-employed TB / Pleurisy / Leprosy patients:

    • Past service counted

  • Surplus staff:

    • Treated as fresh entrants

  • Voluntary transfer to lower post (FR-15):

    • Placed below all existing incumbents

  • Sportspersons:

    • Seniority as per selection method (SSC/direct)

2. Departmental Promotion Committee (DPC)

(A) Composition & Nature

  • DPC assesses fitness objectively

  • Recommendations are advisory, require approval of appointing authority

(B) Frequency

  • Held annually

  • Vacancy year = Calendar Year

  • Crucial date for eligibility: 1st January

(C) Inclusion

  • Officers on deputation / foreign service must be considered if eligible

  • Vigilance clearance mandatory

(D) Disagreement with DPC

  • If authority disagrees:

    • Matter sent back to DPC

    • If reiterated → higher authority / Minister decides

(E) Validity of Panel

  • Normally 1 year

  • If DPC meets multiple days → validity from last meeting date

3. Promotion

(A) Regular Promotion

  • Vacancies calculated from:

    • Establishment / Vacancy / Roster Registers

  • Deputation vacancies (>1 year) included

(B) Minimum Qualifying Service

  • Varies from 1 to 12 years depending on Pay Level (as per 7th CPC)

(C) Reservation in Promotion

  • SC: 15%, ST: 7.5%

  • Only where Direct Recruitment ≤ 75%

  • No reservation for OBC, Ex-servicemen, etc.

(D) Out-of-Turn Promotion (Sportspersons)

  • Only for medals in:

    • Olympics, Commonwealth, Asian Games, World Championships

  • Max 3 times in entire career

4. Ad-hoc Promotion

  • Last resort

  • Allowed when:

    • Promotion is sub-judice

    • Short-term vacancy (>45 days)

    • DR quota unfilled

5. Pro-forma Promotion (Next Below Rule)

  • Applicable to officers on deputation / training

  • Conditions:

    • Found fit

    • Seniors and one junior promoted

    • Only one seniormost officer eligible

  • Pay protected with reference to junior’s pay

6. Declining Promotion

  • If declined with valid reason:

    • No promotion for 1 year

    • Seniority lost in first panel

  • If declined without valid reason:

    • Promotion may be enforced

    • Disciplinary action possible

7. APAR & Promotion Link

  • APARs are core basis for:

    • Promotion

    • Confirmation

    • FR-56(j) review

  • Below-benchmark APARs must be communicated

  • Representation allowed; final grading binding on DPC
