1. Warning / Admonition / Reprimand

  • Issued for minor lapses (negligence, carelessness, lack of thoroughness).

  • Not a punishment and not a penalty.

  • Copy may be kept in personal file.

  • If mentioned in APAR, it becomes an adverse entry and must be communicated.

  • Does not bar promotion.

2. Disciplinary Proceedings

  • Governed by CCS (CCA) Rules, 1965.

  • Initiated by Disciplinary Authority (DA).

  • Charges must be specific, clear, and supported by evidence.

3. Penalties (Rule 11)

Minor Penalties

  1. Censure

  2. Withholding of promotion

  3. Recovery of pecuniary loss

  4. Withholding of increments

  5. Reduction by one stage (up to 3 years, no cumulative effect)

Major Penalties

  1. Reduction to lower stage/grade/post

  2. Compulsory retirement

  3. Removal from service

  4. Dismissal from service

4. Inquiry – When Mandatory

  • For all major penalties.

  • For minor penalties when:

    • Increment withheld > 3 years

    • Increment with cumulative effect

    • Pension likely to be affected

5. Procedure – Major Penalty

  • Charge-sheet issued with:

    • Articles of charge

    • Statement of imputations

    • List of witnesses & documents

  • 15–45 days to submit defence.

  • Inquiry by Inquiry Officer (IO).

  • Government servant has right to:

    • Inspect documents

    • Defence assistant

    • Legal practitioner (in some cases)

  • Inquiry report submitted within 6 months.

  • Final order after considering representation.

6. Procedure – Minor Penalty

  • Charge-sheet issued.

  • Opportunity to submit defence.

  • Inquiry held only if required.

7. Suspension

  • Not a penalty.

  • Grounds:

    • Pending disciplinary proceedings

    • Criminal case

    • Prejudicial to State security

  • Review mandatory within 90 days.

  • Cannot continue without review.

  • Deemed suspension:

    • Detention > 48 hours

    • Conviction with imprisonment > 48 hours

8. Subsistence Allowance

  • Equal to half pay + DA.

  • Reviewed after 3 months.

  • Can increase/decrease up to 50%.

9. Appeal

  • Filed within 45 days.

  • Appellate Authority examines:

    • Procedure followed?

    • Findings justified?

    • Penalty proportionate?

10. Revision & Review

  • Revision: Higher authority (including President).

  • Review: Only on new facts/material.

11. Proceedings After Retirement

  • Pension can be withheld or reduced for:

    • Serious crime

    • Grave misconduct

  • Proceedings can continue after retirement with Presidential sanction.
